I finally just bought my first home. There was only one contingency, which was that the sellers would remove a ton of junk that was scattered around the 4 acre property. The junk ranges from old rotted car trailers, to old windows from a remodel, and most notably includes 3 large box truck beds/boxes full of trash, each of which are between 12 and 18 feet long and around 8 feet tall. On the day of the final walk through, I discovered that not only had they failed to remove anything, they had also destroyed a bunch of the junk and scattered it around the property. Obviously I wasn’t happy, and I told their agent I wouldn’t sign. He told me not to worry and that he would write up an agreement stating that they would pay a company to remove everything. He even had someone come to the property and give us a quote. He told everyone at the closing table including the closing attorneys that he was going to do so in the other room. At this point, my rate lock was about expire and I was either going to sign or have to move on to the next house I could find at a lower price. We all believed he was taking care of it. After I signed he told me it was taken care of. It turns out he never wrote a proposal. Now I’m stuck with a property that looks like a literal dump, and he’s telling me it isn’t his problem. He even told me it’s only going to cost me around $5,000.00 to remove and if that doesn’t work I should just rent a dump truck and a loader and do it myself. I could go to small claims court but I don’t know where that will get me. Does anyone have any advice or ideas?
